Can I sell my plot to a bank?

Question

I am resubmitting my question third time (Resubmitted first after two weeks, now resubmitting after one week):

1. Can I sell my plot to a bank?

2. I deal in importing kitchens. Can I sell kitchens to a banker if somehow I get to know that buyer is a banker? What if I don't know that buyer is a banker?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh

We have not received your query before. This is probably due to our quota system.

It is permissible to sell a plot of land to the bank.[1]

It is permissible to sell goods to a banker.

And Allah Ta’āla Knows Best

وَلَا بَأْسَ بِبَيْعِ الْعَصِيرِ مِمَّنْ يَجْعَلُهُ خَمْرًا؛ لِأَنَّ الْعَصِيرَ مَشْرُوبٌ طَاهِرٌ حَلَالٌ، فَيَجُوزُ بَيْعُهُ، وَأَكْلُ ثَمَنِهِ، وَلَا، فَسَادَ فِي قَصْدِ الْبَائِعِ إنَّمَا الْفَسَادُ فِي قَصْدِ الْمُشْتَرِي، وَلَا تَزِرُ وَازِرَةٌ وِزْرَ أُخْرَى.

(أَلَا تَرَى) أَنَّ بَيْعَ الْكَرْمِ مِمَّنْ يَتَّخِذُ الْخَمْرَ مِنْ عَيْنِهِ جَائِزٌ لَا بَأْسَ بِهِ، وَكَذَلِكَ بَيْعُ الْأَرْضِ مِمَّنْ يُغْرَسُ فِيهَا كَرْمًا لِيَتَّخِذَ مِنْ عِنَبِهِ الْخَمْرُ، وَهَذَا قَوْلُ أَبِي حَنِيفَةَ

قال: "ولا بأس ببيع العصير ممن يعلم أنه يتخذه خمرا"؛ لأن المعصية لا تقام بعينه بل بعد تغييره، بخلاف بيع السلاح في أيام الفتنة لأن المعصية تقوم بعينه.

قال: "ومن أجر بيتا ليتخذ فيه بيت نار أو كنيسة أو بيعة أو يباع فيه الخمر بالسواد فلا بأس به" وهذا عند أبي حنيفة
