Question regarding Qadha Salah and Fast

Question

I have a question regarding both prayer and fasting. I haven't prayed in about 2-3 months and I don't know how and if I should make it up or just repent sincerely. Same goes for fasting. I didn't make up my fasts for two ramadans ina row and I don't know how or if I should make it up. Any advice?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

Assalāmu ῾alaykum wa Rahmatullāhi Wabarakātu

If one has missed Fardh Salats and Fasts, that is a major sin for which one should regret and repent. A believer should be ever conscious of his Salats and Fasts.[1]

It is part of repentance to make Qadha(make up) for the missed Salats and fasts.

The missed Salah and Fast could be done gradually but as soon as possible. For example, perform one qadha Salah, with every present Salah. When performing Zohar Salah, perform another four rakaats with the intention of qadha.[2]

Keep a record of the missed Salah and made up Salats until you complete your missed Salats. In the case of missed Ramadan fasts, adopt a gradual procedure. It will be easy to fast once or twice a week or in winter everyday due to the short days.[3] We also advise, perform qadha Salah in place of Nafl Salats.[4]

Have courage and commence your qadha Salah and fasts. Insha Allah it will be easy and finally done with.

مَنْ يَجِبُ عَلَيْهِ الْقَضَاءُ:

اتَّفَقَ الْفُقَهَاءُ عَلَى وُجُوبِ قَضَاءِ الصَّلاَةِ الْفَائِتَةِ عَلَى النَّاسِي وَالنَّائِمِ….. فَأَمَّا الْمُتَعَمِّدُ فِي التَّرْكِ، فَيَرَى جُمْهُورُ الْفُقَهَاءِ أَنَّهُ يَلْزَمُهُ قَضَاءُ الْفَوَائِتِ، وَمِمَّا يَدُل عَلَى وُجُوبِ الْقَضَاءِ حَدِيثُ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ: أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَمَرَ الْمُجَامِعَ فِي نَهَارِ رَمَضَانَ أَنْ يَصُومَ يَوْمًا مَعَ الْكَفَّارَةِ (3) أَيْ بَدَل الْيَوْمِ الَّذِي أَفْسَدَهُ بِالْجِمَاعِ عَمْدًا، وَلأَِنَّهُ إِذَا وَجَبَ الْقَضَاءُ عَلَى التَّارِكِ نَاسِيًا فَالْعَامِدُ أَوْلَى

التاخير بلا عذر كبيرة لا تزول بالاقضاء بل بالتوبة اى بعد القضاء اما بدونه فالتاخير باق فلم تصح التوبة منه (رد المحتار،1/755)

وقضاء رمضان ان شاء فرقه وان شاء تابعه لاطلاق النص لكن المستحب المتابعة مسارعة الى اسقاط الواجب(شرح البداية،1/262)

والضرب الثانى ما ثبت فى الذمة كقضاء شهر رمضان و صوم الكفارة فلا يجوز الا بنية من اليل(شرح البداية، 1/98)

و لو نوى قضاء رمضان ولم يعين اليوم صح، ولو عن رمضانين كقضاء الصلاة صح ايضا وان لم ينو فى الصلاة اول صلاة عليه او اخر صلاة عليه كذا فى الكنز قال المصنف قال الزيلعى و الاصح اشتراط التعيين فى الصلاة و فى رمضانين (شرح التنوير مسائل الشتى، 5/718)

و قضاء رمضان ان شاء فرقه وان شاء تابعه لكن الامستحب المتابعة مسارعة الى اسقاط الواجب

وان اخره حتى دخل رمضان آخر صام الثانى لانه فى وقته و قضى الاول بعده لانه وقت القضاء ولا فديه عليه لان وجوب القضاء على التراخى(شرح البداية،2/204)
