Is Qurbani Wajib if a person pays zakat each year?

Question

Assalamoualaikoum

I would like to know if qurbaani is obligatory each year if a person is paying zakaat each year.

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

Assalāmu ῾alaykum wa Rahmatullāhi Wabarakātuh

In principle, Qurbani is waajib (mandatory) on every individual who has an excess of money equivalent to the nisaab of zakat on the 10th, 11th and 12th of Dhul Hijjah.

The nisaab of zakat is 612.35 grams of silver, or 87.48 gram of gold or its equivalent in monetary value.

If a person after paying zakat and deducting his liabilities from his wealth, has the excess of money as described, Qurbani will be Waajib upon him. This will apply for all times. [1]

قال القدورى فى شرحه: الأضحية واجبة عند أصحابنا رحمهم الله تعالى .و شرط وجوبها اليسار عند أصحابنا ، والموسر فى الظاهر الرواية من له مائتا درهم ،أو عشريون دينارا، أو شئ يبلغ ذالك (سوى مسكنه ،ومتاعه،و مركوبه،و خادمه،فى حاجته التى لا يستغنى عنها،فام ما عدا ذالك ) سائمة ، او رقيق ،او خيل او متاع للتجارة او لغيرها ،فانه يتعد به فى يساره(المحيط البرهاني،8/455,ادارة القرآن)

أما وقت الوجوب فأيام النحر فلا تجب قبل دخول الوقت ..،وأيام النحر ثلاثة: يوم الأضحي،وهو العاشر من ذى الحجة،والحادى عشر ، والثانى عشر ،و ذالك بعد طلوع الفجر من اليوم الاول الى غروب الشمس من الثانى عشر.

ولو كان عليه دين بحيث لو صرف نصابه لا ينقص نصابه ،لا تجب ، لان الدين يمنع وجوب الزكاة ، فلان يمنع وجوب الأضحية اولى ، لان الزكاة فرض والاضحية واجبة، والفرض فوق الواجب.(بدائع الصنائع،6/283,دار الكتب العلمية)
