Performing Dhuhr with intention of Qadha

Question

Assalamu Alaikum.

Hope you are well.

Just had a question....

If someone performs zuhr with the intention of qadha

(thinking that zuhr time has passed)After salah he realises that zuhr time has not lapsed...will his salah be valid? His niyyat shouldve been for adaa but he made niyyat for qadhaa....?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

The Salah is valid. [1]

(قوله لصحة القضاء بنية الأداء إلخ) هذا التعليل إنما يظهر إذا نوى الأداء، أما إذا تجردت نيته فلا. اهـ ط والمناسب ما في الأشباه عن الفتح: لو نوى الأداء على ظن بقاء الوقت فتبين خروجه أجزأه وكذا عكسه، ثم مثل له ناقلا عن كشف الأسرار بقوله: كنية من نوى أداء ظهر اليوم بعد خروج الوقت على ظن أن الوقت باق، وكنية الأسير الذي اشتبه عليه رمضان فتحرى شهرا وصامه بنية الأداء فوقع صومه بعد رمضان، وعكسه كنية من نوى قضاء الظهر على ظن أن الوقت قد خرج ولم يخرج بعد،...
