Punishment for married man who committed zina with young girl

Question

What is the punishment in Islam for a married man who has comitted zina with a prepubescent girl younger than nine years of age?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

In general, and without reference to any specific incident or person;

If a married person is convicted of committing zina in a country ruled by Shariah, he will be stoned to death.[1]

عَنْ جَابِرٍ: أَنَّ رَجُلًا مِنْ أَسْلَمَ، جَاءَ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَاعْتَرَفَ بِالزِّنَا، فَأَعْرَضَ عَنْهُ النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ حَتَّى شَهِدَ عَلَى نَفْسِهِ أَرْبَعَ مَرَّاتٍ، قَالَ لَهُ النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «أَبِكَ جُنُونٌ» قَالَ: لاَ، قَالَ: «آحْصَنْتَ» قَالَ: نَعَمْ، فَأَمَرَ بِهِ فَرُجِمَ بِالْمُصَلَّى، فَلَمَّا أَذْلَقَتْهُ الحِجَارَةُ فَرَّ، فَأُدْرِكَ فَرُجِمَ حَتَّى مَاتَ. فَقَالَ لَهُ النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ خَيْرًا، وَصَلَّى عَلَيْهِ

أَخْبَرَنَا إِسْمَاعِيلُ بْنُ مَسْعُودٍ الْجَحْدَرِيُّ، قَالَ: حَدَّثَنَا خَالِدُ بْنُ الْحَارِثِ، قَالَ: حَدَّثَنَا ابْنُ عَوْنٍ، عَنْ مُحَمَّدٍ، قَالَ: نُبِّئْتُ عَنِ ابْنِ أَخِي كَثِيرِ بْنِ الصَّلْتِ، قَالَ: كُنَّا عِنْدَ مَرْوَانَ، وَفِينَا زَيْدُ بْنُ ثَابِتٍ، فَقَالَ زَيْدٌ: كُنَّا نَقْرَأُ: «الشَّيْخُ وَالشَّيْخَةُ فَارْجُمُوهُمَا أَلْبَتَّةَ» فَقَالُ مَرْوَانُ: أَلَا تَجْعَلْهُ فِي الْمُصْحَفِ قَالَ: قَالَ: أَلَا تَرَى أَنَّ الشَّابَّيْنِ الثَّيَّبِيَنِ يُرْجَمَانِ؟ ذَكَرْنَا ذَلِكَ وَفِينَا عُمَرُ فَقَالَ: أَنَا أَشْفِيكُمْ قُلْنَا: وَكَيْفَ ذَلِكَ؟ قَالَ: أَذْهَبُ إِلَى رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، إِنْ شَاءَ اللهُ فَأَذْكُرُ كَذَا وَكَذَا فَإِذَا ذَكَرَ أَيَّةَ الرَّجْمِ فَأَقُولُ: يَا رَسُولَ اللهِ، أَكْتِبْنِي آيَةَ الرَّجْمِ قَالَ: فَأَتَاهُ فَذَكَرَ ذَلِكَ لَهُ فَذَكَرَ آيَةَ الرَّجْمِ فَقَالَ: يَا رَسُولَ اللهِ، أَكْتِبْنِي آيَةَ الرَّجْمِ قَالَ: «لَا أَسْتَطِيعُ»
