Brother in Islam,
If your partner took money from the outsider and did not invest the money in the construction business, then the partner is totally responsible for the money he took. He should repay the outsider the money he took. If the money given as profit was from the construction business, the partner will have to even repay that to the construction business. The construction company and the two partners are not responsible to pay the outsider anything.[i]
