It is permissible for me to use the damaged item?

Question

Company delivered a damaged item, sent a replacement and said to dispose of it. It is permissible for me to use the damaged item since they don't want it?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

According to your explanation the company has relinquished its rights of the couch and handed it over to you. You may use the couch or give it to anyone you wish.[i]
