Qadha of missed Qurbani - How do i do it?

Question

1.Assalamualaikum. I didnot perform my qurbani in the previous years despite of having the nisab amount. Now I have tried to remember from the past and came to a conclusion that I have not performed qurbani for 3 years. But I donot remember the exact year. Recently I gave the amount of one qurbani in charity and intended that of the three Qurbaanis that is wajib upon me, I am paying for one qurbani. Is the qada of the qurbani valid? 2. In future while paying for the rest of the qada Qurbani, will it be okay to make the intention that this is for the first Qada qurbani that is wajib on me?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

If during the days of Qurbani (i.e. the 10, 11 or 12th of Zul Hijjah) a person did not perform a Qurbani that was Waajib on him, then he will have to give a live goat or sheep or its value as Sadaqah to poor Muslims who are eligible for Zakaat.

If a person slaughters a goat or sheep, then all the meat, skin etc. must be given as Sadaqah to poor Muslims who are eligible for Zakaat.[i]

The method you mention in your query is correct. You may adopt this method for the remaining Qadha Qurbani’s.

One should keep in mind that when calculating the amount to pay for each Qadha Qurbani, the price of a sheep or goat must be used and not the price of one share in a cow or buffalo etc.

وَإِنْ نَوَى بَعْضُ الشُّرَكَاءِ التَّطَوُّعَ وَبَعْضُهُمْ يُرِيدُ الْأُضْحِيَّةَ لِلْعَامِ الَّذِي صَارَ دَيْنًا عَلَيْهِ وَبَعْضُهُمْ الْأُضْحِيَّةَ الْوَاجِبَةَ عَنْ عَامِهِ ذَلِكَ جَازَ الْكُلُّ، وَتَكُونُ عَنْ الْوَاجِبِ عَمَّنْ نَوَى الْوَاجِبَ عَنْ عَامِهِ ذَلِكَ، وَتَكُونُ تَطَوُّعًا عَمَّنْ نَوَى الْقَضَاءَ عَنْ الْعَامِ الْمَاضِي، وَلَا تَكُونُ عَنْ قَضَائِهِ بَلْ يَتَصَدَّقُ بِقِيمَةِ شَاةٍ وَسَطٍ لِمَا مَضَى، كَذَا فِي فَتَاوَى قَاضِي خَانْ.

بدائع الصنائع في ترتيب الشرائع (5/ 68)

وَمَنْ وَجَبَتْ عَلَيْهِ الْأُضْحِيَّةُ فَلَمْ يُضَحِّ حَتَّى مَضَتْ أَيَّامُ النَّحْرِ ثُمَّ حَضَرَتْهُ الْوَفَاةُ فَعَلَيْهِ أَنْ يُوصِيَ بِأَنْ يُتَصَدَّقَ عَنْهُ بِقِيمَةِ شَاةٍ مِنْ ثُلُثِ مَالِهِ؛ لِأَنَّهُ لَمَّا مَضَى الْوَقْتُ فَقَدْ وَجَبَ عَلَيْهِ التَّصَدُّقُ بِقِيمَةِ شَاةٍ فَيَحْتَاجُ إلَى تَخْلِيصِ نَفْسِهِ عَنْ عُهْدَةِ الْوَاجِبِ، وَالْوَصِيَّةُ طَرِيقُ التَّخْلِيصِ فَيَجِبُ عَلَيْهِ أَنْ يُوصِيَ كَمَا فِي الزَّكَاةِ وَالْحَجِّ وَغَيْرِ ذَلِكَ.

الجواب وباللّٰہ التوفیق: صاحب نصاب اگر کسی وجہ سے ایام قربانی میں قربانی نہ کرسکا حتی کہ ایام قربانی گذر گئے تو اس پر قربانی کے لائق متوسط درجہ کی بھیڑیا بکری کی قیمت کا صدقہ کرنا واجب ہے، بڑے جانور کے ساتویں حصہ کی قیمت صدقہ کرنا کافی نہ ہوگا۔
