Is a child born out of wedlock a Mahram to the adulterer's daughters?

Question

Assalamualaikum. Respected Mufti Saheb, A man is married, while being married, he has an affair with another married lady, a child is born, a boy. Is the boy born a "sister" to the man's daughters from his marriage? Are this man's daughters and this boy mahram to each other? Can they openly talk to each other?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu 'alaykum wa-rahmatullāhi wa-barakātuh.

The child (boy) will be regarded as the legitimate child of the married woman's husband and not the child of the person who had an affair with the married woman.[1]

Rasulullah (Sallallahu Alayhi Wasallam) said:

The child (from an illegitimate relationship) belongs to (the owner of) the bed (the husband) and the stone (the punishment) is for the fornicator.[2]

The boy will be a Ghair Mahram to the daughters of his biological father, i.e., the daughters of the married man who had an affair with the married woman.[3]

Therefore, it will be impermissible for the boy (when he matures) to openly talk and engage with the daughters of the married man.

جواب- جائز ہے قال فی الشامیۃ ویحل لاصول الزانی وفروعہ اصول المزنی بھا وفروعہا - فقط واللہ تعالیٰ اعلم
