Silently reciting with the Imam during Tarawih prayers

Question

Assalamualaikum respected mufti

is it permissible for the muqtadi to silently recite along with the imam during taraweeh prayers.

Jazakumullah.

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

According to Ahnaaf, it is not permissible for a muqtadi to recite [silently or audibly] along with the imam during Taraweeh.[i]

(وَالْمُؤْتَمُّ لَا يَقْرَأُ مُطْلَقًا) وَلَا الْفَاتِحَةَ فِي السَّرِيَّةِ اتِّفَاقًا، وَمَا نُسِبَ لِمُحَمَّدٍ ضَعِيفٌ كَمَا بَسَطَهُ الْكَمَالُ (فَإِنْ قَرَأَ كُرِهَ تَحْرِيمًا) وَتَصِحُّ فِي الْأَصَحِّ. وَفِي دُرَرِ الْبِحَارِ عَنْ مَبْسُوطِ خُوَاهَرْ زَادَهْ

(قَوْلُهُ وَلَا الْفَاتِحَةَ) بِالنَّصْبِ مَعْطُوفٌ عَلَى مَحْذُوفٍ تَقْدِيرُهُ لَا غَيْرَ الْفَاتِحَةِ وَلَا الْفَاتِحَةَ، وَقَوْلُهُ فِي السَّرِيَّةِ يُعْلَمُ مِنْهُ نَفْيُ الْقِرَاءَةِ فِي الْجَهْرِيَّةِ بِالْأَوْلَى، وَالْمُرَادُ التَّعْرِيضُ، بِخِلَافِ الْإِمَامِ الشَّافِعِيِّ وَيَرِدُ مَا نُسِبَ لِمُحَمَّدٍ (قَوْلُهُ اتِّفَاقًا) أَيْ بَيْنَ أَئِمَّتِنَا الثَّلَاثَةِ. (قَوْلُهُ وَمَا نُسِبَ لِمُحَمَّدٍ) أَيْ مِنْ اسْتِحْبَابِ قِرَاءَةِ الْفَاتِحَةِ فِي السَّرِيَّةِ احْتِيَاطًا (قَوْلُهُ كَمَا بَسَطَهُ الْكَمَالُ) حَاصِلُهُ أَنَّ مُحَمَّدًا قَالَ فِي كِتَابِهِ الْآثَارِ: لَا نَرَى الْقِرَاءَةَ خَلَفَ الْإِمَامِ فِي شَيْءٍ مِنْ الصَّلَوَاتِ يَجْهَرُ فِيهِ أَوْ يُسِرُّ، وَدَعْوَى الِاحْتِيَاطِ مَمْنُوعَةٌ، بَلْ الِاحْتِيَاطُ تَرْكُ الْقِرَاءَةِ لِأَنَّهُ الْعَمَلُ بِأَقْوَى الدَّلِيلَيْنِ. وَقَدْ رُوِيَلْفَسَادُ بِالْقِرَاءَةِ عَنْ عِدَّةٍ مِنْ الصَّحَابَةِ فَأَقْوَاهُمَا الْمَنْعُ (قَوْلُهُ أَنَّهَا تَفْسُدُ) هَذَا مُقَابِلُ الْأَصَحِّ (قَوْلُهُ وَهُوَ) أَيْ الْفَسَادُ الْمَفْهُومُ مِنْ تَفْسُدُ (قَوْلُهُ مَرْوِيٌّ عَنْ عِدَّةٍ مِنْ الصَّحَابَةِ) قَالَ فِي الْخَزَائِنِ: وَفِي الْكَافِي: وَمَنْعُ الْمُؤْتَمِّ مِنْ الْقِرَاءَةِ مَأْثُورٌ عَنْ ثَمَانِينَ نَفَرًا مِنْ كِبَارِ الصَّحَابَةِ، مِنْهُمْ الْمُرْتَضَى وَالْعَبَادِلَةُ وَقَدْ دَوَّنَ أَهْلُ الْحَدِيثِ أَسَامِيَهُمْ (قَوْلُهُ وَيُنْصِتُ إذَا أَسَرَّ) وَكَذَا إذَا جَهَرَ بِالْأَوْلَى. قَالَ فِي الْبَحْرِ: وَحَاصِلُ الْآيَةِ أَنَّ الْمَطْلُوبَ بِهَا أَمْرَانِ الِاسْتِمَاعُ وَالسُّكُوتُ، فَيَعْمَلُ بِكُلٍّ مِنْهُمَا، وَالْأَوَّلُ يَخُصُّ الْجَهْرِيَّةَ، وَالثَّانِي لَا فَيَجْرِي عَلَى إطْلَاقِهِ فَيَجِبُ السُّكُوتُ عِنْدَ الْقِرَاءَةِ مُطْلَقًا
