Question

Is it permissible to initiate Salaam with a Faasiq / Faajir? Many Muslims do not keep a beard or wear their trousers below the ankles, so can Salaam be initiated with them?

What will be the ruling with regard to parents that are Faasiq on the basis of not keeping a Shari’ee beard?

Answer

Salaam should not be made to a Faasiq (an open violator of the laws of Shariah) unless he repents from the sin that he is involved in. The Fuqaha have written that making Salaam to a Faasiq is Makrooh.

However, in this day and age, majority of the people are far from Deen. We should, therefore, repeatedly make an effort to rectify their errors with love and affection as long as there is hope of them reforming. Yes, if they remain adamant on their wrong action and continue to sin openly without any intention of reforming, then one may refrain from making Salaam to them.

When one is required to obey his disbelieving parents (in permissible matters), then he is required to obey and make Salaam to his Muslim parents to a greater extent, even though they may be violating the laws of Shariah. He should try to rectify their matters with respect and honour.

أنه يكره السلام على الفاسق —– وفي فصول العلامي: ولا يسلم على الشيخ الممازح والكذاب واللاغي، ولا على من يسبه الناس أو ينظر وجوه الأجنبيات، ولا على الفاسق المعلن، ولا على من يغني أو يطير الحمام ما لم تعرف توبتهم. (رد المحتار ص617 ج1)

وَصاحِبْهُما فِي الدُّنْيا صحابا مَعْرُوفاً يرتضيه الشرع والعقل.

(مسئلة) يجب بهذه الاية الانفاق على الأبوين الفقيرين وصلتهما وان كانا كافرين عن اسماء بنت ابى بكر قالت قدمت علىّ أمي وهى مشركة فى عقد قريش فقلت يا رسول الله ان أمي قدمت علىّ وهى راغبة أفأصلها قال نعم صليها- متفق عليه- وقد مرّ فى سورة العنكبوت ان هاتين الآيتين نزلتا فى سعد بن ابى وقاص وامه (التفيسر المظهري ص256 ج7)
