Security companies hiring out guards to taverns and nightclubs

Question

Is it permissible for a security company to offer their services to a club or tavern in lieu of a fee?

Answer

It is not permissible for a security company to offer their services to businesses that are involved in acts of sin and disobedience such as nightclubs, taverns etc. The Quraan Sharif states, “And do not assist in acts of sin and transgression.” [Re:- Surah Maa’idah Verse 2] Also, the income acquired from taverns and nightclubs are Haraam, hence it will not be permissible for the security company to derive an income therefrom.

وإذا استأجر الذمي من المسلم بيتا ليبيع فيه الخمر لم يجز لأنه معصية فلا ينعقد العقد عليه ولا أجر له عندهما وعند أبي حنيفة رحمه الله يجوز والشافعي رحمه الله يجوز هذا العقد لأن العقد يرد على منفعة البيت ولا يتعين عليه بيع الخمر فيه فله أن يبيع فيه شيئا آخر يجوز العقد لهذا ولكنا نقول تصريحهما بالمقصود لا يجوز اعتبار معنى آخر فيه وما صرحا به معصية

قال رحمه الله (وإجارة بيت ليتخذ بيت نار أو بيعة أو كنيسة أو يباع فيه خمر بالسواد) يعني جاز إجارة البيت لكافر ليتخذ معبدا أو بيت نار للمجوس أو يباع فيه خمر في السواد وهذا قول الإمام وقالا يكره كل ذلك
