ʿIddah Period of a Woman in Menopause

Question

Dear mufti saheb. I have a question… How does one work her iddah period if she had a hysterectomy done. She is 55 years old.

Answer

As salām ʿalaikum wa raḥmatullāhī wa barakātuhū

In the Name of Allāh, the Most Gracious, the Most Merciful.

When a woman reaches the age of 55 lunar years (53 solar years and 4 months), she is regarded as having reached menopause if she no longer has menstrual periods.

The ʿiddah period for a woman who has reached menopause ends after 3 full months from the time of the divorce.

Accordingly, if the ʿiddah period is due to divorce, she will wait for 3 full months. If, however, if the woman’s husband had passed away, her ʿiddah will be 4 months and 10 days.

And Allāh Taʿālā knows best.

)وعدة الصغيرة والآيسة الحرة: ثلاثة أشهر، وإن كانت أمة: فشهر ونصف).وذلك لقول الله تعالى: {واللائي لم يحضن}، وعدة الأمة على النصف من عدة الحرة، ولا خلاف بين المسلمين فيها.وقد روي عن النبي صلى الله عليه وسلم أنه قال: “طلاق الأمة تطليقتان، وعدتها حيضتان”.وقال عمر بن الخطاب: “لو استطعت أن أجعلها حيضة ونصف، لفعلت”، يعني أن الحيضة لا تتبعض، فلذلك كانت عدتها حيضتين. (وإذا حاضت الصغيرة قبل انقضاء العدة: استأنفت العدة بالحيض).وذلك لأن الله تعالى أوجب الشهور عند عدم الحيض، فإذا وجدت الحيض، بطل حكم الشهور، فانتقلت إلى الحيض
