What is the ruling of reading bismillah when slaughtering?

Question

What is the ruling of reading bismillah when slaughtering? Is there any difference in the ruling if it is left out intentionally or unintentionally?

Answer

If bismillah is left out unintentionally, then the animal is halaal and permissible. However, if it is left out intentionally, then the animal will not be halaal.

(لا) تحل (ذبيحة) غير كتابي من (وثني ومجوسي ومرتد ... وتارك تسمية عمدا) خلافا للشافعي (فإن تركها ناسيا حل) (الدر المختار 6/298)

تحل إذا تركها ساهيا ولا تحل إذا تركها عامدا لقوله تعالى ولا تأكلوا مما لم يذكر اسم الله عليه وهو قول أبي حنيفة وأصحابه وابي عبد الله ( النتف في الفتاوى 1/229)

ومنها التسمية حتى لو تركها عامدا لا يحل عندنا وعند الشافعي يحل وأجمعوا أنه لو تركها ناسيا يحل والمسألة معروفة (تحفة الفقهاء 3/66)

وإن ترك الذابح التسمية عمدا فالذبيحة ميتة لا تؤكل وإن تركها ناسيا أكلت (مختصر القدوري صـ 206)

(وإن تركها ناسيا أكلت) لأن في تحريمه حرجا عظيما لأن الإنسان قلما يخلو عن النسيان فكان في اعتباره حرج والحرج مدفوع ولأن الناسي غير مخاطب بما نسيه بالحديث هو قوله صلى الله عليه وسلم رفع عن أمتي الخطأ والنسيان فلم يترك فرضا عليه عند الذبح بخلاف العامد كما في الاختيار (اللباب في شرح الكتاب 3/224)
