Question

What amount of mahr will a woman be entitled to if her husband divorced her immediately after the Nikah (before spending any time with her in privacy)?

Answer

She will be entitled to receive half the stipulated mahr.

( و ) يجب نصفه بطلاق قبل وطء أو خلوة )… ( وكذا يجب ) مهر المثل ( فيما إذا لم يسم ) مهرا ( أو مات عنها إذا لم يتراضيا على شيء ) يصلح مهرا ( وإلا فذلك ) الشيء… ( و ) تجب ( متعة لمفوضة ) وهي من زوجت بلا مهر ( طلقت قبل الوطء وهي درع وخمار وملحفة لا تزيد على نصفه ) أي نصف مهر المثل لو الزوج غنيا ( ولا تنقص عن خمسة دراهم ) لو فقيرا (الدر المختار)

قال الشامي: قوله ( قبل وطء أو خلوة ) هو معنى قول الكنز قبل الدخول فإن الدخول يشمل الخلوة أيضا لأنها دخول حكما كما في البحر عن المجتبى (رد المحتار/باب المهر 3/102-110)
