Musaafir mistakenly reads four rakaats as Imaam
Question
If a musaafir mistakenly reads four rakaats as Imaam of Zohr, should all repeat the salaah? What if he reads four rakaats intentionally?
Answer
The muqeems as well as the Imaam must repeat the namaaz.

من خرج من عمارة موضع إقامته . . . مسيرة ثلاثة أيام ولياليها . . . صلى الفرض الرباعي ركعتين وجوبا (الدر المختار 1/121)
فلو أتم المقيمون صلاتهم معه فسدت لأنه اقتداء المفترض بالمتنفل ظهيرية أي إذا قصدوا متابعته أما لو نووا مفارقته ووافقوه صورة فلا فساد أفاده الخير الرملي (رد المحتار 2/130)
( فإذا أتم الرباعية و ) الحال أنه ( قعد القعود الأول ) قدر التشهد ( صحت صلاته ) لوجود الفرض في محله وهو الجلوس على الركعتين وتصير الأخريان نافلة له ( مع الكراهة ) لتأخير الواجب وهو السلام عن محله إن كان عامدا فإن كان ساهيا يسجد للسهو ( وإلا ) أي وإن لم يكن قد جلس قدر التشهد على رأس الركعتين الأوليين ( فلا تصح ) صلاته لتركه فرض الجلوس في محله واختلاط النفل بالفرض قبل كماله (حاشية الطحطاوي 425)
