Telling one's friend: "I have divorced my wife, you can go and marry her"

Question

Zaid told his friends that he has divorced his wife you can go and marry her. Has The divorce taken place or not?

Answer

Yes, the divorce is valid.

الطلاق على ضربين صريح وكناية فالصريح قوله أنت طالق ومطلقة وطلقتك فهذا يقع به الطلاق الرجعي ... ولا يفتقر إلى النية (الهداية 2/359)

وأما الضرب الثاني وهو الكنايات لا يقع بها الطلاق إلا بالنية أو بدلالة الحال (الهداية 2/373)
