Marrying the daughter of a woman one touched over her clothes with lust

Question

A boy who was baaligh, touched a woman. the boy was full of lust but the woman was fast asleep. he touched her over her clothes. She did not wake up. A number of years have past. This boy now desires to marry the daughter of this woman. Is this allowed in islam. Can the boy marry this girl?

Answer

If he has touched her clothes, then provided the heat of the body was felt then nikaah with her daughter is not permissible.

( و ) حرم أيضا بالصهرية ( أصل مزنيته ) أراد بالزنى الوطء الحرام ( و ) أصل ( ممسوسته بشهوة ) ولو لشعر على الرأس بحائل لا يمنع الحرارة

قال الشامي في رد المحتار : قوله ( ولو لشعر على الرأس ) خرج به المسترسل وظاهر ما في الخانية ترجيح أن مس الشعر غير محرم وجزم في المحيط بخلافه ورجحه في البحر وفصل في الخلاصة فخص التحريم بما على الرأس دون المسترسل وجزم به في الجوهرة وجعله في النهر محمل القولين وهو ظاهر فلذا جزم به في الشارح قوله ( بحائل لا يمنع الحرارة ) أي ولو بحائل الخ فلو كان مانعا لا تثبت الحرمة كذا في أكثر الكتب وكذا لو جامعها بخرقة على ذكره فما في الذخيرة من أن الإمام ظهير الدين يفتي بالحرمة في القبلة على الفم والذقن والخد والرأس وإن كان على المقنعة (رد المحتار 3/ 32)
