Question

Is fxcm.com halal or haram. It is forex.

This is what you do in forex, buy 1 usd dollar when it is equal 2 euro dollar and sell it when it is more than 2 or equal to 3 usd dollars.

For example: I bought when it was like this, 1 USD = 2 EURO. I will sell when it becomes 1 USD = 3 EURO or more than 2 EURO.

So is it halaal or haram? Can you tell me why is it halaal or haram, and also say at the end of your answer, this "It is halaal" or "it is haram" so I can understand clearly.

Answer

If you have taken possession of the dollar and thereafter you wish to trade in Euros then it is permissible, provided the transaction is done cash on the spot.

And Allah Ta'ala (الله تعالى) knows best.

قال ويجوز بيع الفلس بالفلسين بأعيانهما عند أبي حنيفة وأبي يوسف رحمهما الله وقال محمد لا يجوز لأن الثمنية تثبت باصطلاح الكل فلا تبطل باصطلاحهما وإذا بقيت أثمانا لا تتعين فصار كما إذا كانا بغير أعيانهما وكبيع الدرهم بالدرهمين ولهما أن الثمنية في حقهما تثبت باصطلاحهما إذ لا ولاية للغير عليهما فتبطل باصطلاحهما وإذا بطلت الثمنية تتعين بالتعيين ولا يعود وزنيا لبقاء الاصطلاح على العد إذ في نقضه في حق العد فساد العقد فصار كالجوزة بالجوزتين بخلاف النقود لأنها للثمنية خلقة وبخلاف ما إذا كانا بغير أعيانهما لأنه كالىء بالكالىء وقد نهى عنه وبخلاف ما إذا كان أحدهما بغير عينه لأن الجنس بانفراده يحرم النساء (الهداية 3/81)
