Buying products on instalment

Question

Buying any product by instalment is jaez or not? I mean a products real price is 3000 but if I buy it in 3 terms then I have to pay 1100 in each term so total 3300,is it permissible?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

It is permissible to sell and purchase on instalments on condition the final purchase price and terms of payments is mutually agreed upon, even though the instalment price is more than the cash price. In the example cited, it is permissible to purchase an item for R3300 payable over three terms, even though the cash price would be R3000. [1]

لَا مُسَاوَاةَ بَيْنَ النَّقْدِ، وَالنَّسِيئَةِ؛ لِأَنَّ الْعَيْنَ خَيْرٌ مِنْ الدَّيْنِ، وَالْمُعَجَّلَ أَكْثَرُ قِيمَةً مِنْ الْمُؤَجَّلِ بدائع الصنائع في ترتيب الشرائع (187/5)

وَلَوْ اشْتَرَى شَيْئًا نَسِيئَةً لَمْ يَبِعْهُ مُرَابَحَةً حَتَّى يُبَيِّنَ؛ لِأَنَّ لِلْأَجَلِ شُبْهَةَ الْمَبِيعِ وَإِنْ لَمْ يَكُنْ مَبِيعًا حَقِيقَةً؛ لِأَنَّهُ مَرْغُوبٌ فِيهِ أَلَا تَرَى أَنَّ الثَّمَنَ قَدْ يُزَادُ لِمَكَانِ الْأَجَلِ بدائع الصنائع في ترتيب الشرائع (224/5)

كَذَا إذَا قَالَ: بِعْتُكَ هَذَا الْعَبْدَ بِأَلْفِ دِرْهَمٍ إلَى سَنَةٍ أَوْ بِأَلْفٍ وَخَمْسِمِائَةٍ إلَى سَنَتَيْنِ؛ لِأَنَّ الثَّمَنَ مَجْهُولٌ، وَقِيلَ: هُوَ الشَّرْطَانِ فِي بَيْعٍ وَقَدْ رُوِيَ أَنَّ رَسُولَ اللَّهِ -صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ «نَهَى عَنْ شَرْطَيْنِ فِي بَيْعٍ». فَإِذَا عَلِمَ وَرَضِيَ بِهِ جَازَ الْبَيْعُ؛ لِأَنَّ الْمَانِعَ مِنْ الْجَوَازِ هُوَ الْجَهَالَةُ عِنْدَ الْعَقْدِ وَقَدْ زَالَتْ فِي الْمَجْلِسِ بدائع الصنائع في ترتيب الشرائع (158/5)
