Can I make Qadha of Witr Salaah with 1 Rak’aat

Question

Can a follower of Hanafi madhab [who missed two years of salat] offer Qadha of Witr salat in 1 rak'a instead of three? If yes, how should he do it?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

According to the Hanafi Madhab, the minimum number of Rak’aats is two. Witr is three Rak’aats with one salaam at the end of the third Rak’aat.

Therefore, it is not permissible to make Qadha of Witr Salaah with one Rak’aat. [1]

أَنَّ الْوِتْرَ ثَلَاثُ رَكَعَاتٍ لَا يُسَلِّمُ إلَّا فِي آخِرِهِنَّ عِنْدَنَا، وَقَالَ الشَّافِعِيُّ - رَحِمَهُ اللَّهُ - تَعَالَى: رَكْعَةٌ وَاحِدَةٌ وَقَالَ مَالِكٌ - رَحِمَهُ اللَّهُ تَعَالَى -: ثَلَاثُ رَكَعَاتٍ بِتَسْلِيمَتَيْنِ

(وَلَنَا) حَدِيثُ عَائِشَةَ - رَضِيَ اللَّهُ تَعَالَى عَنْهَا - كَمَا رَوَيْنَا «فِي صِفَةِ قِيَامِ رَسُولِ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - ثُمَّ يُوتِرُ بِثَلَاثٍ» «وَبَعَثَ ابْنُ مَسْعُودٍ - رَضِيَ اللَّهُ تَعَالَى عَنْهُ - أُمَّهُ لِتُرَاقِبَ وِتْرَ رَسُولِ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - فَذَكَرَتْ أَنَّهُ أَوْتَرَ بِثَلَاثِ رَكَعَاتٍ قَرَأَ فِي الْأُولَى سَبِّحْ اسْمَ رَبِّك الْأَعْلَى وَفِي الثَّانِيَةِ قُلْ يَا أَيُّهَا الْكَافِرُونَ وَفِي الثَّالِثَةِ قُلْ هُوَ اللَّهُ أَحَدٌ وَقَنَتَ قَبْلَ الرُّكُوعِ» وَهَكَذَا ذَكَرَ ابْنُ عَبَّاسٍ - رَضِيَ اللَّهُ تَعَالَى عَنْهُمَا - حِينَ بَاتَ عِنْدَ خَالَتِهِ مَيْمُونَةَ لِيُرَاقِبَ وِتْرَ رَسُولِ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - وَلَمَّا رَأَى عُمَرُ - رَضِيَ اللَّهُ تَعَالَى عَنْهُ - سَعْدًا يُوتِرُ بِرَكْعَةٍ فَقَالَ مَا هَذِهِ الْبُتَيْرَاءُ لَتَشْفَعَنَّهَا أَوْ لَأُوذِيَنَّكَ وَإِنَّمَا قَالَ ذَلِكَ؛ لِأَنَّ الْوِتْرَ اُشْتُهِرَ «أَنَّ النَّبِيَّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - نَهَى عَنْ الْبُتَيْرَاءِ» وَقَالَ ابْنُ مَسْعُودٍ - رَضِيَ اللَّهُ تَعَالَى عَنْهُ - وَاَللَّهِ مَا أَخَّرْت رَكْعَةً قَطُّ وَلِأَنَّهُ لَوْ جَازَ الِاكْتِفَاءُ بِرَكْعَةٍ فِي شَيْءٍ مِنْ الصَّلَوَاتِ لَدَخَلَ فِي الْفَجْرِ قَصْرٌ بِسَبَبِ السَّفَرِ وَلَا حُجَّةَ لَهُ فِيمَا رُوِيَ فَإِنَّ اللَّهَ تَعَالَى وِتْرٌ لَا مِنْ حَيْثُ الْعَدَدِ

قوله: "ثلاث ركعات" بالتحريك وقد تسكن قوله: "كان يوتر بثلاث" وهذا مذهب الفقهاء السبعة وروى ابن أبي شيبة في مصنفه عن الحسن البصري قال أجمع السلف على أن الوتر ثلاث لا يسلم إلا في آخرهن وهو مذهب أبي بكر وعمر والعبادلة وأبي هريرة روي أنعمر رضي الله تعالى عنه رأى سعيدا يوتر بركعة فقال: ما هذه البتيراء تشفعها أو لأؤدبنك اهـ وروي أن سعد بن أبي وقاص أوتر بركعة فقال له عبد الله بن مسعود: ما هذه البتيراء ما أجزأت ركعة قط وروي أنه حلف على ذلك اهـ كذا في الشرح
