Question

Salaam. Muslim girl and non muslim guy get married without performing nikkah. After the marriage a son is born and after a few years the couple get divorced. Years after the Ex husband has passed away it is discovered there is money owed to him. Can the son inheret and the deceased also leaves behind brothers and one sister but parents are also deceased. Jazakallah.

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

In principle, it is not permissible for a Muslim girl to marry a non-Muslim man.[i] Hence, the marriage was invalid and the child born thereof was born out of wedlock. The child will not inherit from the father.[ii]

However, if the brothers or sister of the deceased wish to forfeit a portion of their inheritance in favour of the child, they may do so.
