Question

What is the shar’ee ruling regarding a Haaji who missed the wuqoof in Muzdalifah due to heavy traffic?

Answer

One damm becomes waajib upon him.

و لو ترك الوقوف بمزدلفة بلا عذر لزمه دم وان كان بعذر بان كان علة أو ضعف أو كانت امرأة تخاف ازحام فلا شيء عليه (غنية 279) ( شامي 2/511 )

و اما ترك الواجبات بعذر فلا شيء عليه ثم مرادهم بالعذر ما يكون من الله تعالى فلو كان من العباد فليس بعذر (غنية 239)
