Missing wuqoof in Muzdalifah due to sickness

Question

What is the Shar’ee ruling regarding a haaji who missed the wuqoof in Muzdalifah due to sickness? Will damm be waajib upon him?

Answer

Damm will not be waajib upon him.

وهذا الوقوف من الواجبات عندنا وليس بركن حتى لو تركها أصلا يلزمه الدم ولكن يجزئه الحج بخلاف الوقوف بعرفة (المحيط البرهاني 2/429)

ولو ترك الوقوف بمزدلفة بلا عذر لزمه دم وان كان بعذر بأن كان علة أو ضعف أو كانت امرأة تخاف الزحام فلا شيء عليه (غنية الناسك صـ 279)

وأما ترك الواجبات بعذر فلا شيء عليه ثم مرادهم بالعذر ما يكون من الله تعالى فلو كان من العباد فليس بعذر (غنية الناسك صـ 239)
