Shohar ka khula qabool karna shart hai

Question

خاتون سے سسرال والوں کی نہ بن سکی اور سسرالیوں نے گھر سے نکال دیا میکے والوں کی طرف سے دباؤ میں آکے خلع کا مقدمہ کیا گیا لیکن سسرال سے کوئ عدالت نہ آیا اور فیصلہ تنسیخ نکاح کا ہوا۔ اور 3 سال بعد شوہر نے اس تنسیخ نکاح کی بنیاد پر خلع موثر سرٹیفکیٹ حاصل کیا لیکن یونین کونسل کی طرف سے خاتون کو اطلاع نہیں دی گئ۔ اس بارے میں رہنمائی کریں۔ خاتون نے ابھی تک اس خلع کو غیر شرعی مانتے ہوۓ رجسٹر نہیں کروایا۔ خاتون یہ معاملہ آباد ہونے کی صورت میں کرنا چاہتی ھیی۔ راہنمائی کر دیں۔ جزاک اللہ

Answer

Agar shohar ne khula ko qabool nahi kiya, to khula mutabar nahi he.

And Allah Ta'ala (الله تعالى) knows best.
